    Agreement to Terms of Use

    These Terms of Use apply to the Canada Post Corporation ("Canada Post") Site. (the "Site").

    THESE TERMS OF USE AFFECT YOUR LEGAL RIGHTS AND RESPONSIBILITIES AND CREATE A LEGALLY BINDING CONTRACT BETWEEN YOU AND CANADA POST.

    BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE.

    If you are using the Site on behalf of a business or if you are an administrator using the Site on behalf of an individual or individuals, the business or the individual(s) accepts these Terms of Use and you (1) represent and warrant that you have the authority to bind the business or individual(s) and (2) agree to these Terms of Use on behalf of the business or individual(s).

    Licence

    On the condition that you comply with these Terms of Use, Canada Post grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, limited licence to enter and use the Site and Applications including, if you are eligible and register here, the use of an Account.

    You are permitted to use your Account only as an end-user. You may not sell, lease, lend or otherwise transfer use of or access to your Account, or any part of it, to anyone else.

    Additional Terms and Conditions May Apply

    Additional Terms and Conditions apply to some specific Products, Features, Applications, and Activities. All Additional Terms and Conditions are incorporated into and form part of these Terms of Use. If there is a conflict between these Terms of Use and any Additional Terms and Conditions, the Additional Terms and Conditions will apply to the extent of the conflict, except that, regardless of what is set out in any Additional Terms and Conditions, the Disclaimers and Exclusion of Liability set out in these Terms of Use will apply to your use of the Site.

    You may click on the links below to access the Additional Terms and Conditions that apply to the corresponding Products, Features and/or Activities specified. This list is for convenience only.  Not all Additional Terms and Conditions are on this list.

    For any Additional Terms and Conditions not listed above, the applicable Additional Terms and Conditions may be located at the respective web page on the Site describing the Product, Feature or Activity to which the Additional Terms and Conditions apply.  In some cases, we will make available to you the applicable Additional Terms and Conditions when you request to use a certain Product, Feature or Activity.

    Commercial Contracts

    For some Products we may require you to sign a Commercial Contract, which will apply in addition to these Terms of Use and any Additional Terms and Conditions.   Those Commercial Contracts may incorporate and/or be subject to other Canada Post documents including the Canada Postal Guide and/or Customer Guides.  Other than with respect to your use of the Site, if there is any conflict between these Terms of Use and the Commercial Contract, the Commercial Contract will apply to the extent of the conflict.   However, these Terms of Use will govern your use of the Site regardless of what is set out in the Commercial Contract.

    Changes

    Canada Post may at any time without notice change the Site, these Terms of Use and/or any Additional Terms and Conditions.   
    It is your responsibility to check the Site regularly for changes.  Your continued use of the Site following the posting of changes to these Terms of Use and/or any Additional Terms and Conditions will mean that you accept and agree to the changes.

    Canada Post Corporation Act

    Notwithstanding anything else in these Terms of Use, any Additional Terms and Conditions, any Commercial Contract or any other document, your use of the Site and/or purchase of any Product is subject to the provisions of the Canada Post Corporation Act and its Regulations (the “Act”).  To the extent there is any conflict between the Act and anything else, the Act will govern.

    Your Contact Information

    It is your responsibility to ensure that your Profile and all other information you provide to us is and remains accurate and complete. You must not provide misleading information or pretend to be someone else.

    Privacy Statement

    Canada Post's Privacy Statement applies to the use of the Site and to the use of Canada Post's Products. The Privacy Statement is incorporated into and forms part of these Terms of Use. View Canada Post's full Privacy Statement here.

    For certain activities you conduct on the Site we may share your personal information with Third Party identification services. Those Third Party services will use the information to help us verify your identity. This will help to protect you and Canada Post against fraud and to protect your personal information from misuse.

    With your consent Canada Post will send you certain electronic communications such as emails, texts and/or app notifications regarding your use of Canada Post's Products. These may include commercial electronic messages such as special offers and promotions.  Your service provider may charge you fees to receive these communications --- check with your service provider.

    You may opt out of receiving commercial electronic messages either by (1) unsubscribing within the commercial electronic message and following the prompts to manage your communications from Canada Post, or (2) signing in to your Account and accessing your information, and then following the instructions on that page for opting out. Your request to unsubscribe will take effect within 10 business days.

    You may opt out of receiving mobile Application notifications from your mobile device.

    There are some communications from which you will not be able to unsubscribe, for example notices that are reasonably required for security purposes or the operation of a Product, and/or notices to you that are required under these Terms of Use. 

    Notifications to You

    To communicate with you, including to provide any written notices to you, we may (1) send you emails or texts, (2) deliver messages to your Inbox or phone, (3) post notices on the Site, (4) send push notifications or (5) use any combination of those methods.

    Content and Intellectual Property

    Canada Post either owns or is the licensee of all intellectual property rights in the Content. 

    You may not publish, display or otherwise use any Content in any form or media unless you first obtain our express written consent and comply with any terms and conditions we specify relating to that use. Without limiting that restriction, and except as may be expressly permitted by these Terms of Use, you are not permitted to (1) copy, download or reverse engineer Content, (2) upload or encode anything on the Site, and/or (3) transmit any Content to any other computer, server, website or other medium.

    We may make available some Content for downloading from the Site.  You may use that Content but only for the purposes and in the manner we specify.  Our permission to use the Content we make available is also conditional on the following:

    (1) You must not (a) pass off the Content as your own or any party's other than Canada Post, (b) make any changes to the Content, or (c) make any representations or warranties to any other party relating to any the Content, and

    (2) You must comply with these Terms of Use, any applicable Additional Terms and Conditions, any applicable Licence Agreement and Canada Post’s Trademark Guidelines.

    Your Use of the Site

    In using the Site, you must comply with the laws of Canada and any applicable Canadian provincial laws. You must not do or threaten to do anything that may or does (1) constitute any illegal or improper activity, (2) harass any other party (3) disrupt, undermine, corrupt or damage the Site or anything accessible through the Site; or (4) damage Canada Post’s goodwill or reputation.  

    Without limiting what is set out above, you must not:

    (1) access, copy or monitor any portion of the Site , or
    (2) reproduce or circumvent the navigational structure or presentation of the Site,

    Any conditions or restrictions on your use of the Site also apply to any system, network, server or other equipment connected to the Site.

    Accounts, Passwords, Security

    To use some portions of the Site you will be required to open an Account and create Authentication Information, for example a Username and Password.

    You must keep your Authentication Information secret. You are responsible for all activities connected to your Account when conducted using your Authentication Information. If you forget any of your Authentication Information, we will try to help you recover it. But if we can’t authenticate you to our satisfaction you will not be able to access your Account.

    You must notify us immediately of any unauthorized use of your Account and/or Authentication Information, or any other security breach of which you become aware. We may suspend or cancel your Account but you will be responsible for all activity connected to your Account before that suspension or cancellation takes effect. 

    You must not use anyone else's Account or Authentication Information except as expressly permitted by applicable Canadian law, for example under a power of attorney for property or in your capacity of administrator for the account holder's estate, or with express written permission from Canada Post.

    We may at any time require you to change your Username and/or or other Authentication Information.

    Internet transmissions are never completely private or secure. Despite any security measures that we may have in place, unauthorized parties might intercept any information transmitted within, to or from the Site, or improperly access any data pertaining to you that we store. You assume all risk that unauthorized interception or access might occur even if we have stated that a particular transmission (for example, credit card information) is secure and/or encrypted.

    Termination or Suspension of the Site or Accounts

    We may at any time without notice suspend or permanently terminate:

    • your Account; and/or
    • the operation of the Site and/or your access to the Site or any portion of the Site.

    Inactive Accounts

    Without limiting our right to suspend or terminate your Account as set out above, we may permanently terminate your Account if we determine that you have not logged into the Account for more than two years.

    Deletion of Account Data

    Among other steps we may take when we terminate your Account, we may permanently delete all documents, information and other data contained in that Account.

    Disclaimers

    We have taken considerable care to prepare and maintain the Site. HOWEVER, WE ARE PROVIDING THE SITE AND ANY PRODUCTS YOU PURCHASE THROUGH THE SITE STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS.  Your use of the Site and/or purchase of any Product is at your sole risk.  Canada Post disclaims all warranties, expressed or implied, including implied warranties of accuracy, merchantability and fitness for a particular purpose.

    We may at any time without notice suspend or terminate operation of the Site and/or your access to the Site or any portion of the Site.

    Exclusion of Liability

    NOTWITHSTANDING ANYTHING ELSE IN THESE TERMS OF USE OR ANY OTHER COMMUNICATION OR DOCUMENT, THE CANADA POST PARTIES WILL NOT BE RESPONSIBLE FOR ANY LOSS OR DAMAGES WHATSOEVER IN CONNECTION WITH THE SITE, APPLICATIONS, ANY CONTENT, PURCHASES OF ANY PRODUCTS, COMMUNICATIONS TO AND FROM CANADA POST, OR ANY SOFTWARE, LINKED SITES, INFORMATION OR DOCUMENTS CONTAINED IN OR ACCESSED VIA THE SITE.  THIS EXCLUSION OF LIABILITY APPLIES NO MATTER WHAT KIND OF LOSS OR DAMAGE YOU EXPERIENCE, INCLUDING, WITHOUT LIMITATION, LOSS OF USE, LOST OR CORRUPTED DATA, LOST BUSINESS PROFITS, BUSINESS INTERRUPTION, PRODUCT DEFECTS, PROPERTY DAMAGE, PERSONAL INJURY OR ANY OTHER LOSS OR DAMAGE.

    THIS EXCLUSION OF LIABILITY APPLIES:

    (1) WHETHER THE ACTION IS IN CONTRACT, TORT OR OTHERWISE.

    (2) EVEN IF CANADA POST IS EXPRESSLY ADVISED OF THE POSSIBILITY OF LOSS OR DAMAGES; AND

    (3) NO MATTER WHAT CAUSED THE LOSS OR DAMAGES, INCLUDING WITHOUT LIMITATION CANADA POST’S NEGLIGENCE AND/OR GROSS NEGLIGENCE.

    THIS EXCLUSION OF LIABILITY APPLIES TO THE FULLEST EXTENT PERMITTED BY LAW.

    Indemnity

    You will indemnify the Canada Post Parties against all claims, demands, damages, losses, fines, expenses (including all legal fees and costs) and/or any other type of liability (collectively, "Claims") to the extent the Claim is caused by (1) your breach of these Terms of Use, and/or (2) your use of the Site. We may, in our sole discretion, assume the exclusive defence and control of any Claim otherwise subject to this indemnification by you.  Even if we assume the defence of a Claim you will remain responsible for the payment of the Claim, and you will cooperate as fully as reasonably required by us in the defence of any Claim.

    Breach by You of the Terms of Use

    If we determine that you have breached these Terms of Use, we may pursue any and all available remedies available to us, in any combination.  These remedies include termination of your access to the Site, with or without notice to you. 

    Any breach by you of these Terms of Use may cause irreparable harm to Canada Post for which monetary damages would be inadequate. We may seek, in addition to the other remedies available to us, any injunctive or equitable relief that we deem appropriate, without needing to post a judicial bond.

    Feedback

    From time to time you may give us Feedback, either at our request or on your own initiative.

    By submitting any Feedback, you agree that:

    (1) The Feedback will automatically become Canada Post’s property,

    (2) Canada Post has no obligation to you or any other party with respect to your Feedback, including any obligation to (a) to review the Feedback, (b) make any payments in connection with the Feedback, or (c) keep the Feedback confidential,

    (3) Canada Post may freely use or redistribute your Feedback for any purpose and in any way, and

    (4) Sections (1), (2) and (3) above will apply regardless of what you state when you submit your Feedback. 

    Third Party Content and Links to Third Party Sites or Applications

    Your use of any Third Party product, service and/or Linked Site or Application is solely at your own risk. Without limiting the Disclaimers or Exclusion of Liability set out in these Terms of Use, Canada Post has no responsibility or liability whatsoever for:

    (1) any information provided by any Third Party on the Site or any Linked Site, including any product or service claim, warranty, representation, promotion or contest; or

    (2) any Third Party action, non-action, products, Applications or services.

    We may sometimes refer to Canada Post "partners" on the Site. We use the term “partner” simply to describe a Third Party that we do business with, and not to describe any kind of legal partnership or similar relationship.

    A Linked Site will let you leave the Site and connect you with Third Party websites. Canada Post does not control or operate the Linked Sites. We are not responsible for the content or security of any Linked Site.

    Official Languages

    Canada Post complies with the Official Languages Act and we are committed to ensuring all Content on this site is available in both French and English. However, some information from external sources may only be available in the language in which it was provided. In addition, some Linked Sites are not subject to the Official Languages Act.

    Governing Law

    These Terms of Use and all disputes or other matters arising out of your use of the Site will be governed by the laws of the Province of Ontario and the applicable laws of Canada, without regard to conflict of law principles. Any dispute will be dealt with solely by a court of competent jurisdiction in Canada or such other location as the parties may expressly agree.

    Connect

    The Connect service enables secure electronic communications between businesses and other parties. Canada Post may from time to time establish eligibility criteria to use the   Connect service.

    If there is a  Connect Commercial Contract in place, then, in addition to the  Terms and Conditions and the Canada Post Terms of Use, the Commercial Contract will apply to and bind (1) the signatories to the Commercial Contract; and (2) any Authorized User specified in the Commercial Contract. Use of  Connect by any other party will in any case be subject to the  the Canada Post Terms of Use.

    If the email address(es) linked to your  Connect account change, it is your responsibility to inform any companies using   Connect of any such changes.

    A company in possession of an email address(es) linked to your  Connect account will be able to create Conversations with you including file attachments without any subscription request by you. You will not need to provide your  Canada Post Username to those companies in order to communicate with them using Connect. To stop receiving information in your Connect account, you will need to contact the company directly and ask them to not contact you via Connect.

    Canada Post assumes no responsibility for any actions taken (or not taken) by you, companies using Connect, or any other party with respect to any content transmitted using Connect, including subject lines, message content and files.

    Virus Protection

    You are solely responsible for protecting your computer, systems, data and other property by using your own virus detection software, firewalls and other security measures. Please note, due to the nature of the file encryption used, we do not scan attachments sent via Connect.

    Capacity, File and Retention Limits

    We may set limits for file attachment size in Messages and Conversations, individual file sizes, file types, and Message retention (expiry period), and we may change those limits at any time without notice.

    ONLINE PURCHASES

    The purchase of any item through the Site is subject to the Canada Post Terms of Use, in addition to any terms and conditions presented on the check-out and/or payment page when you make your purchase.

    We try to accurately describe items for sale through the Site, but our descriptions may not be 100% correct or complete. If you purchase an item on the Site and it does not match the item's description on the Site, your only remedy is to return the item (if the item is returnable) in accordance with the online returns policy set out on the Site.

    CANADA POST SOLUTIONS FOR SMALL BUSINESS TERMS AND CONDITIONS

    Participation in Canada Post’s Solutions for Small Business program is subject to these Solutions for Small Business Terms and Conditions and the Canada Post Terms of Use. Only businesses resident in Canada are eligible to participate in the Solutions for Small Business program, and all participants are understood by Canada Post to be a business for all Solutions for Small Business program purposes, including but not limited to tax refund purposes.

    Canada Post reserves the right, in its sole discretion, to review any Solutions for Small Business application or membership and to take such action as it deems appropriate, including the refusal, suspension or deletion of any account, if it believes there has been a violation of any of these terms and conditions or the Solutions for Small Business Terms and Conditions. Such violations include, but are not limited to, the creation of duplicate accounts for the same customer or user, or the use of multiple accounts for the purpose of applying promotional codes or offers to additional items. In a case where duplicate accounts are detected, Canada Post reserves the right to refuse, close or merge such duplicate accounts in its sole discretion at any time and without notification to you. Additional items will incur shipping costs at Canada Post’s standard rates or may be returned to the sender.

    These Solutions for Small Business Terms and Conditions and the Canada Post Terms of Use supersede any previous terms and conditions for Solutions for Small Business or any predecessor service, including any VentureOne™ terms and conditions previously agreed to by you.

    Purchases of any Products through the Solutions for Small Business Program will also be subject to:

    (1) Any Commercial Contract to which you are a party;

    (2) The Canada Postal Guide;

    (3) Any Additional Terms and Conditions applicable to a Product;

    (4) The Contract Customers and Solutions for Small Business Prices found on our website. Sign in to your online Business Profile to view your customer account discount level

    If there is a conflict among any of the documents listed above, the order of precedence to resolve the conflict will be the order in which the documents are listed.

    International Shipping Solutions

    Up to 60% off the Canada Post “base rate” (the rate available to customers sending packages or parcels over the counter at a post office.

    The discounted rate is determined by your “shipping profile” which includes, but is not limited to:

    • the volume commitment
    • the service(s) selected
    • the service options selected
    • the weight of items
    • the origin and destination of the items
    • the number and location of induction points (postal facility where the items are posted)
    • the customer contract or agreement

    A change in a customer’s shipping profile may result in a change in rates available to the customer

    Business Information and Authority

    Only businesses resident in Canada are eligible to participate in the Solutions for Small Business Program. To participate, you must apply for an account here. You represent and warrant that (a) you are a business or the authorized representative of a business; (b) all information that you provide to us is business information and not personal information, including any contact details.

    Note that any information used to communicate with an individual in relation to their employment, business or profession (such as what would ordinarily be found on a business card) is considered business information, and not personal information.

    We will retain the information that you provide to us and will use it in connection with (1) the Site, (2) the Solutions for Small Business program, and (3) to provide you with information about us and our Products.

    How to purchase Products

    You may purchase Canada Post shipping and/or mailing Products through the following means:

    (1) by signing into your Account and paying by credit card accepted by Canada Post using one or more of the following online Applications: (i) Electronic Shipping Tool (EST) Online, (ii) EST 2.0, (iii) Express Order Entry, (iv) Precision Targeter, (v) Snap Ship, or (vi) Snap Admail.

    (2) at a Canada Post Retail Outlet, using whatever payment methods are accepted at that outlet, or

    (3) for Canada Post Personalized Mail™ or Canada Post Neighbourhood Mail™ only, through Canada Post Smartmail Marketing Partners or Smartmail Marketing Expert Partners, using whatever payment methods are accepted by the applicable Partner.

    Pricing and Savings Levels

    Pricing for Products may differ depending on the means by which you purchase them.

    We may make available special Solutions for Small Business price Savings Levels. We will determine your Savings Level based on your Annual Volume of eligible items. Click here to see the Annual Volumes corresponding to each Savings Level.

    We’ll review your eligible volumes quarterly. If as a result of a quarterly review we determine that you are on track to exceed your Annual Volume, we may apply a higher Savings Level (resulting in more of a discount) to your account. If we determine that you are not on track to achieve your Annual Volume, we may apply a lower Savings Level to your account (resulting in less of a discount). However, we won’t lower your Savings Level more than once every twelve months, and not within the first twelve months of the date on which we provided you with your Solutions for Small Business customer number.

    If we apply a higher or lower Savings Level to your account, the new Savings Level will take effect on the date we specify and will apply to all of your eligible Neighbourhood Mail deposits from that date forward unless we notify you otherwise. We may provide notice of any changes by posting to the Site. It is your responsibility to log into your Account and check your Savings Level before you deposit any items.

    Availability of a Savings Level is conditional on you complying will these Solutions for Small Business Terms and Conditions.

    Changes

    Canada Post may at any time without notice:

    (1) Modify, suspend or terminate the Solutions for Small Business program;

    (2) Suspend or terminate your Solutions for Small Business account;

    (3) Change prices; and/or

    (4) Modify, suspend or cease to offer Savings Levels.

    Customer Numbers

    We provide a customer number to each Solutions for Small Business participant. Only deposits you make under your customer number will count toward our determination of whether you are on track to achieve your Annual Volume. You are solely responsible to ensure that your customer number has been used for each deposit. We will not apply your customer number retroactively to any deposit.

    Membership Card

    We issue a membership card to each Solutions for Small Business participant. The membership card will remain the property of Canada Post, and you must promptly return it to us upon our request.

    FIND A POSTAL CODE TERMS AND CONDITIONS

    These Find a Postal Code Terms and Conditions apply to the Find a Postal Code Service in addition to the Canada Post Terms of Use.

    Ownership of postal codes

    Canada Post is the sole creator and owner of the postal codes and all associated data accessed through the Find a Postal Code Service. Postal codes are “Content” as defined in the Canada Post Terms of Use.

    Permitted use of Find a Postal Code

    You must not sell or otherwise commercially exploit the information you obtain from the Find a Postal Code Service, or use that information for any purpose other than your own personal or limited internal business use. Canada Post may without notice limit the number of searches you make using the Find a Postal Code Service, on a daily or other basis.

    No representations or warranties

    Without limiting the Disclaimers or Exclusion of Liability in the Canada Post Terms of Use, Canada Post is providing the Find a Postal Code Service strictly on an “as is” basis. Canada Post makes no representations or warranties about the accuracy of the information you obtain by using the Find a Postal Code Service.

    GLOSSARY OF TERMS

    In the Canada Post Terms of Use, the terms set out below have the following corresponding meanings:

    "Account"

    Means your online Canada Post account corresponding to your Authentication Information, used to receive and manage communications from Canada Post, access Products and Features made available through the Site, and other purposes as Canada Post may specify from time to time. If you do not have an Account, you may register for one.

    "Activity"

    Means any purchase of a Product, participation in a program or contest, use of a Product or Feature or any other activity conducted on or through the Site.

    "Additional Terms and Conditions"

    Means terms and conditions stipulated by Canada Post that apply in addition to these Terms of Use to specific Products, Applications,  Features and/or Activities.

    "Affiliate"

    Means an affiliate as defined in the Canada Business Corporations Act.

    "Annual Volume"

    Means the annual volume of items in a specified Product category, deposited for delivery by Canada Post by a Solution for Small Business participant, using the customer number assigned by Canada Post to the Solution for Small Business participant.

    "Application"

    Means any software that is run by or affiliated with Canada Post, including but not limited to mobile applications, a software application developed specifically for use on small, wireless computing devices, such as smartphones and tablets, rather than desktop

    "Authentication Information"

    Means a User's Password, Username, Security Question, Security Answer and other information that Canada Post may require from time to time in order to verify a User's identity.

    "Bank"

    Means an entity that is:

    (1) a Canadian bank listed in Schedule I of the Bank Act (Canada); or

    (2) a credit union regulated by a Canadian province;

    "Canada Post"

    Means Canada Post Corporation.

    "Canada Post Documents"

    Means non-confidential materials that Canada Post has prepared and provided for general access, viewing and/or downloading on the Site, including Customer Guides, forms, articles, blogs and similar materials.

    "Canada Post Parties"

    Means:

    (1) Canada Post;

    (2) any Affiliate of Canada Post

    (3) any contractor, agent and/or representative of Canada Post and/or any of its Affiliates;

    (4) any director, officer and/or employee of any of the parties listed in (1), (2) or (3) above; or

    (5) any combination of the foregoing.

    "Canada Post Software"

    Means any software we make available on the Site for downloading. Canada Post Software does not include Third Party software even if it is accessed through a link on the Site.

    "Canada Post Terms of Use" or "Terms of Use"

    Mean the Terms of Use governing the use of the Site, found here.

    "Commercial Contract"

    Means a validly executed written contract in the form stipulated or approved by Canada Post, in effect between a business and Canada Post relating to (1) the provision of Products by Canada Post and/or (2) other commercial matters.

    "Content"

    Means all Canada Post Documents, website text, names, Marks, graphics, logos, icons, designs, words, titles, user interfaces, visual interfaces, artwork, Canada Post Software, computer code or phrases on the Site, or any part or parts of them, including any translations into other languages.

    "Customer Guide"

    Means a document of that name relating to a specific Product or Products, as prepared and amended by Canada Post from time to time, setting out features, terms and conditions and/or other aspects applicable to the Product(s) and made available by Canada Post to its commercial customers.

    "Connect"

    Means Canada Post's Connect service.

    "Conversation"

    Means an electronic exchange of information between Connect users. A Conversation will contain individual Messages which are comprised of a text and optionally files.

    "Feature"

    Means any feature, application, Canada Post Software or other functionality made available by Canada Post on the Site.

    "Feedback"

    Means any suggestions, comments, questions or ideas you provide to us in any form or medium, regarding:

    (1) the Site,

    (2) any actual or potential Products and/or

    (3) any other aspect of Canada Post's existing or potential operations.

    "includes" or "including"

    Means "includes" or "including" without limiting the generality of any preceding or following text.

    "Licence Agreement"

    Means an agreement, in the form we stipulate, setting out the terms and conditions pertaining to your use of any Content we make available for downloading from the Site.

    "Linked Site"

    Means a website or Application operated by a Third Party that is linked to the Site.

    Means, when used to describe an action by Canada Post: "may, in our sole discretion, but with no obligation to do so".

    "Marks"

    Means any and all trade names, trademarks, official marks or any similar intellectual property belonging to Canada Post and/or its licensors, which may be registered in Canada or otherwise.

    "Message"

    Means a subsection of a Conversation in the Connect service. Messages can contain text and files.

    "Password"

    Means the secret access code you use to access your Account.

    "Product"

    Means a product or service provided by Canada Post.

    "Profile"

    Means the contact information and other information we ask you to provide when you open an Account.

    "Retail Outlet"

    Means a physical facility operated by Canada Post or another party under contract with Canada Post, for the primary purpose of selling Products to the public and/or businesses.

    "Savings Level"

    Means the applicable discount level for a specified Product, assigned by Canada Post to a Solutions for Small Business program participant, as determined by Canada Post based on volume and/or other criteria established by Canada Post from time to time.

    "Security Answer"

    Means the secret answer provided by you that only you know that corresponds to your Security Question.

    "Security Question"

    Means the secret question chosen by you, that only you know and that corresponds to your Security Answer.

    "Site"

    Means the Canada Post Corporation website - and all associated websites and Applications linked to the Canada Post Corporation website that are operated by Canada Post, its subsidiaries and/or Affiliates. The Site includes:

    (1) your Account, and

    (2) all Content, Features and Products you access while on the Site.

    "Third Party"

    Means a party other than Canada Post or a Canada Post Affiliate.

    "User"

    Means a user of the Site.

    "Username"

    Means the name selected by a User to uniquely identity that User while logged on to the Site.

    "we", "us", "our", "We", "Us" or "Our"

    Means Canada Post.

    "you", "your", "You" or "Your"

    Refers to a User.
